Terms and conditions galleryy International

§1 Coverage
The following General Terms and Conditions, which were valid at the time of order, apply to the business relationship between Gallery and the customer. Galleryy does not accept different terms from customers, unless Galleryy has accepted the terms in writing. By clicking the button “Place order/Buy now/Order now”, the customer accepts the General Terms and Conditions of Galleryy and commits himself to follow them.

§2 Conclusion of contract
A sales contract becomes binding, once Galleryy sends a confirmation of order or ships the ordered product to the customer.  Galleryy is the contractual partner. By accepting the General Terms and Conditions, the customer states that the pictures he provided are free of third parties’ rights.

§3 Right of withdrawal
Should the customer be the consumer, he can revoke his/her contractual statement within 2 weeks and without giving reasons. This period commences the day after the customer has received the goods or the services have been rendered. To meet the deadline, timely mailing of the revokement or the goods shall suffice.

The right of withdrawal does not apply to:
- contracts on shipping of goods or rendered services, that have been produced according to the customer’s specifications or that have been tailored to the particular needs
(This includes orders for caricatures, Pop-art and other Digital art, oil paintings and BOBs).
- goods, that are not ideal for reshipment due to their consistency

§4 Shipment
All delivery times stated by Galleryy are generally estimates. Delivery times stated by the customer during the placing of order will not be accepted by Galleryy and are not part of the sales contract. If shipping is not possible, due to the fact that the customer cannot be located at the stated delivery address, in spite of being notified ahead of time, the customer has to bear the costs for the failed delivery. 

§5 Cooperation obligation of the customer
The customer will receive an email with a preview of products or services rendered, that have been created according to a photographic template provided by the customer. The customer is obliged to give feedback on the product/service rendered by email (approval or change request) within 7 days. If Galleryy does not receive feedback within 7 days after sending the preview, the product/service rendered is rated as approved by the customer. Should the customer report a change request within the deadline of 7 days, one has to differentiate:  
- change request based on additional information, that was not provided at the placing of order, will be charged extra by gallery. Before the implementation of the change request, the customer will receive an estimate, which has to be approved of within 3 days. Without this approval the product will rate automatically as approved.   
- justified change requests based on insufficient quality of the artistic implementation by Galleryy will be changed exempt from charges. The customer will receive an actualized  preview by email after the implementation is finalized. After a precise assessment Galleryy reserves the right to deny these change requests as unjustified. In this case, the product will rate automatically as approved. In case of an automatic approval, the customer commits himself/herself to pay the amount invoiced immediately and before shipment. Shipping of the product/service rendered will commence after the product/service rendered has been paid for by the customer – regardless of the previous agreed terms of payment. 

§6 Liability for defects
Galleryy does not take any responsibility for minor aberrations of the delivered product/service rendered from the offered products/services rendered. The artistic elements of products/services rendered, that have been approved by the customer or were automatically approved of, are disclosed from a statement of complaint. With products/services rendered displayed on the internet or by preview, minor aberrations in the shades of colour are not fully avoidable. Such aberrations do not qualify for a statement of complaint. At the receipt of the product, the packaging must be checked by the customer. In case of existing damage in transit, the provider of logistics has to confirm this in writing and the damage hast to be reported to Galleryy in written form with indication of the invoice number. If nothing further occurs, other claims by the customer, irrespective of legal basis, are foreclosed. Thus Galleryy is not liable for defects, which have not occurred to the delivery item itself; in particular Galleryy is not liable for loss of profit or further financial loss for the customer.

§7 Legal venue
Place of fulfillment and legal venue is Munich/Germany.
